These conditions aim to define the terms of sale between "the seller" and the customer via the site cosimarols.com, from the order to the services, including payment and delivery. They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.
All orders placed on the website cosimarols.com are subject to these general conditions, the acceptance of which constitutes a determining element without which the seller would not have contracted. Any placing of an order requires and constitutes express and unreserved acceptance of these general terms and conditions, which the customer has read prior to the order on the site cosimarols.com where they can be consulted directly. The seller reserves the right to modify its general terms and conditions at any time. In this case, the applicable conditions will be those in force on the date of the order or the express acceptance of the order (day and time in Paris - France).
The fact that the seller does not assert, at a given time, any of these stipulations cannot be interpreted as a waiver of asserting them at a later time.
By accepting the quote, you are placing a firm order to purchase the products advertised at the price. The quote is valid for 30 days from the date of issue. To complete the order process, you must first accept these Terms for your order by accepting the quote. The legally binding contract for the purchase of the products is concluded only upon receipt of your payment. We reserve the right not to accept your order. Custom orders will not be refunded or exchanged. Payment is made by bank transfer and payment is possible in installments.
For custom orders, the deposit paid when ordering is automatically acquired and cannot give rise to any refund. The balance will be due before delivery.
Payments made by the Customer will only be considered final after actual collection of the amounts due by Cosima Rols Joaillerie.
The order confirmation by the customer on the website cosimarols.com is worth signature, acceptance of the operations and contract. All the data entered by the customer and the recorded confirmation of his order will be proof of the transaction. A summary of the order information and these general conditions will be communicated by email to the customer, to the email address confirming his order. The customer is reminded that the seller favors small quantities of stock in order to guarantee the rarity and exclusivity of the pieces. Thus, the seller undertakes to honor the orders received on its website only within the limit of available stocks of the products. In the absence of availability of the product, the seller undertakes to inform the user but cannot be held responsible for the cancellation of an order for a product due to its unavailability.
The seller reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.
All our jewelry is handmade and in France, they require a long labor process. As a result, each order can take a month or more to manufacture (more if a personalized order) before shipping, unless the product is in stock. In addition, because they are handmade, they may present irregularities or some differences in size, color, patterns, compared to the designs proposed when ordering. In this regard, and even if Cosima Rols Joaillerie makes every effort to provide the greatestsatisfaction to the Customer, the stones appearing on the proposed designs may ultimately have a different rendering, these evolving in terms of purity, color and size depending on the Customers' budget.
In accordance with the provisions of Articles L 221-18 et seq. of the Consumer Code, the customer has a period of 14 working days from the date of delivery of the order to return any item that does not suit them to the seller's address appearing on the withdrawal form and request an exchange or refund without penalty, with the exception of return costs which remain the responsibility of the customer. The customer must make within this period a return request by e-mail to the address contact@cosimarols.com so that the seller validates this request. It is therefore recommended to obtain proof of this return, which assumes that the products are returned with parcel tracking, or by any other means providing a certain date. The risks of loss and return costs are always the responsibility of the customer. The products must be returned in their original packaging and unworn. Products returned incomplete or damaged by the customer will not be refunded. You must return the products as quickly as possible, in any case within 14 days of notification of your withdrawal. Upon receipt of the product, we will proceed to a full refund of the product within 14 days.
After-sales service and Return Policy Outside Metropolitan France: return and exchange costs are at the customer's expense outside France. Outside the EEC, customs duties and taxes, and administrative costs are the responsibility of the Customer.
When you receive your delivery, check that the package has not been damaged in front of the delivery person, if this is the case, be sure to check the condition of the product and refuse the package for defective product. The delivery person will take care of exercising their rights and returning the package, we will contact you as soon as possible.
Otherwise, you will not be able to prove damage when the delivery person leaves.
A resizing for rings is possible but if it is a measurement error on your part, it will be chargeable, this is why we ask you to take your measurements carefully before any order, do not hesitate to contact us for any information. The return and shipping will be at your expense.
If it is a size error during manufacturing in the workshop, we will take care of the resizing as well as all return and delivery costs.
Returns must be made in their original condition and complete. The return remains under your responsibility even in the event of loss or damage to the product during the “return” shipment. In this context, your liability is engaged. Any damage suffered by the product on this occasion may be such as to prevent the return. As soon as you take physical possession of the ordered products, the risks of loss or damage to the products are transferred to you.
Concerning jewelry personalized at your request, the withdrawal period does not apply. Personalized items cannot be returned to a classic sales channel in the event of a return. In French law, Article L 221-28 of the Consumer Code provides that the right of withdrawal cannot be exercised. You therefore have 3 days before your order is being processed. After this period, you will no longer be able to cancel the order.
Apart from the legal provisions relating to the right of withdrawal, the seller is in no way required to accept requests for exchange or refund from the customer. If applicable, any request for exchange or refund must be sent by e-mail to contact@cosimarols.com by the customer, who must indicate his/her name, first name, telephone number, order number and the reason for the return. In the event that the seller accepts the request for exchange or refund, the return postal address will be sent by e-mail to the customer, who must then return each item complete (packaging, accessories, instructions), in its original condition and in its original packaging with its return number included in the package giving a specific date to this shipment. No cash on delivery shipment will be accepted.accepted for any reason.
Return costs are free only for exchanges and only in metropolitan France. They remain the responsibility of the customer in the event of a refund request and/or outside metropolitan France. In the case of an exchange in France (and an exchange only), the shipping costs for the second shipment are free, if and only if there was an error on the part of the seller on the product ordered and/or its quality. If the return is justified by an error on the part of the customer on the size when ordering or on a poor assessment of color, texture, cut or more generally the visual rendering, the seller will not be held responsible and the shipping costs for the second shipment will be the responsibility of the customer.
The seller ships from France, and delivers to France and most countries in Europe. Orders are shipped to the address mentioned on the electronic invoice issued upon confirmation of the order and based on the information provided by the customer, within the time indicated on the order validation page. Delivery times, which only begin to run from the day the order is validated and paid, are provided for information purposes only, so that failure to comply with them will not give rise to withholding, compensation or damages and will not be grounds for the cancellation of current orders. Deliveries are made according to stock availability and supply times and subject to any technical difficulties. The seller may not be held liable for delays in delivery related to our supply from our suppliers, nor be liable for penalties or damages of any kind whatsoever, due to a delay or non-delivery due to force majeure or unforeseeable circumstances. Force majeure is considered to be any circumstances beyond the control of the seller, leading to a stoppage or reduction in production, or delivery by its own suppliers. In the event of force majeure, the seller's obligations are suspended without any particular formality, the latter being released from any liability.
Upon receipt of the order, the customer must ensure that the products received are compliant. Any anomaly concerning the delivery (missing or broken product, damaged package) must be notified, on the same day of receipt or at the latest the first working day following receipt, to the customer service contact@cosimarols.com, without which the seller cannot undertake to reimburse the order. The products delivered comply with the seller's offers, subject to the tolerances permitted by the practices of the profession and manufacturers. The seller only guarantees the products sold under the conditions and limits of the legal guarantee of conformity provided for by articles L. 217-1 et seq. of the Consumer Code and the legal guarantee of hidden defects provided for by articles 1641 et seq. of the Civil Code.
The prices of our products are indicated in euros including all taxes (VAT and other taxes applicable on the day of the order, unless otherwise indicated and excluding shipping costs). All orders, regardless of their origin, are payable in euros. In the event of an order to a country other than France, the customer becomes without reservation the importer of the product(s) concerned. Any customs duties or other local taxes or import duties or state taxes that may be payable will be borne by the seller. They will be the responsibility of the seller who makes them his business, under his full responsibility, both in terms of declarations and payments to the competent authorities and organizations of the country concerned by the delivery. The customer is informed that in the event that the payment is made from a country other than France, his bank may charge him fees. They are not the responsibility of the seller and are the responsibility of the customer. Cosima Rols Joaillerie reserves the right to modify its prices at any time, so that the product will be invoiced on the basis of the rate in effect at the time of validation of the order and subject to availability.
Validation of the order, which seals the contract, obliges the customer to pay, prior to their dispatch, the full price of the item(s) ordered with its accessories (VAT, shipping costs, etc.). Payment for purchases is made by Stripe payment methods. Data relating toto the customer's bank card number are encrypted from their computer and are transmitted in this way encrypted directly to the banking operator, who decrypts them and manages the direct debit authorizations. The seller reserves the right to refuse any order or delivery in the event of total or partial non-payment of an order, a refused bank card payment, a previous or current dispute with the customer or for reasons other than Cosima Rols Joaillerie reserves the right to explain to its customer. The liability of the company Cosima Rols Joaillerie cannot then be engaged in any way in this regard.
All jewelry is made of 750/1000th gold, 18 carats, with the eagle's head guarantee hallmark. The jewelry is guaranteed for 5 years against any manufacturing defect.
This commercial guarantee does not apply: in the event of non-compliant use, in the event of damage due to a handling error, to abusive or abnormal use, to an intentional or accidental physical modification, to use for professional or commercial purposes, in the event of abnormal maintenance operations or in the event of a lack of maintenance and hygiene, in the event of natural wear and tear, in the event of work carried out on the jewelry by any person not mandated by Customer Service as well as damage resulting from such work.
These General Terms and Conditions set out the conditions applicable to any purchase made by the Customer. All creations made by Cosima Rols Joaillerie are the property of Cosima Rols Joaillerie, including drawings and sketches made when drawing up quotes. They are protected under copyright and intellectual property rights. Any infringement or reproduction, even partial, is subject to legal action.
We shall not be liable for any delay or failure to fulfil our obligations arising from these Terms if such delay or failure results from a cause beyond our control and/or a case of force majeure within the meaning of Article 1216 of the Civil Code.
